Quick answer
Jesus gently rebukes Nicodemus for not grasping these truths though he is Israel's teacher. The Scriptures already pointed to the Spirit's renewing work.
Overview
As a recognized teacher, Nicodemus should have understood from the prophets (such as Ezekiel and Jeremiah) God's promise to give a new heart and Spirit. The rebuke exposes how religious expertise can miss the heart of God's redemptive plan. It prepares for Jesus' move from 'earthly' to 'heavenly' things in the verses that follow.
